Offered by Dragon Challenge LLC, based in the Commonwealth of Virginia, USA. This Terms of Service agreement applies to your access and use of the Service available at dragonchallenge.app and any related platforms or services we provide.

1. Eligibility

You must meet the minimum legal age to use the Service:

United States and most countries: 13 or older
European Union, United Kingdom, EEA, and Switzerland: 16 or older unless local law permits younger usage with consent
In regions requiring parental or guardian authorization (e.g., Australia, Brazil, South Korea), you must obtain such consent

By using the Service, you represent that you meet the applicable minimum age requirements in your jurisdiction.

2. Account Registration and Third-Party Login

To access certain features, you may create an account with an email and password or use a third-party authentication service (e.g., Google, Apple, Discord). You must provide accurate and current information when creating the account and are responsible for safeguarding your login credentials. You are solely responsible for activity under your account. Notify us immediately of unauthorized use.

3. User Conduct

You agree not to:

Violate any applicable laws or regulations
Use the Service for any illegal or unauthorized purpose
Impersonate others or misrepresent your identity or affiliation
Interfere with or attempt to circumvent security or integrity mechanisms
Introduce viruses, malware, or malicious code
Collect personal data from other users without lawful basis or consent
Use automated systems (e.g., bots, scrapers, crawlers) without prior written authorization

We may suspend or restrict access if we suspect or confirm violations.

4. Intellectual Property

All content, features, and functionality of dragonchallenge.app—and the Service as a whole—are owned by Dragon Challenge LLC or its licensors. They are protected by applicable intellectual property laws. You may not use our trademarks, logos, or trade dress without prior written consent.

5. User Content and License

You retain ownership of any content you submit or upload ("User Content"). By submitting User Content, you grant Dragon Challenge LLC a limited, non-exclusive, revocable, worldwide, royalty-free license to host, store, reproduce, modify, display, and distribute the content solely as needed to operate, maintain, and improve the Service. This license is not transferable or sublicensable except to service providers acting on our behalf. We may remove or retain content as required by law. You affirm that you have the necessary rights to any User Content you provide.

6. Billing, Subscriptions, and Refunds

If you purchase any subscription or paid feature:

You authorize recurring billing until cancellation
Subscriptions renew automatically unless canceled before the renewal date
Refunds are only provided where required by applicable local law or at our discretion
If you believe a billing error occurred, contact us within 30 days

Certain jurisdictions (such as the EU, UK, Brazil, or Australia) may grant statutory cooling-off or withdrawal rights. Where such rights are mandatory, they apply despite anything in these Terms.

7. IP Takedowns and Copyright Infringement

If you believe content on dragonchallenge.app infringes your intellectual property rights:

U.S. users may submit a DMCA notice to our designated agent
International users may submit a similar request with details sufficient to identify the alleged infringement

We will remove or disable access to infringing content as appropriate and may terminate repeat infringers.

8. Privacy and Data Transfer

Our Privacy Policy explains how we collect, use, and protect personal data. By using the Service, you consent to the processing and transfer of your data in the United States and other jurisdictions where we or our service providers operate. For users in regions with data protection laws (e.g., EU/EEA, UK, Canada, Brazil), we rely on standard contractual clauses or equivalent safeguards to legitimize cross-border data transfers.

9. Termination and Suspension

We may suspend or terminate your account if you materially breach these Terms. Unless immediate action is required (e.g., suspected criminal activity or severe security risk), we will provide notice and a 14-day opportunity to remedy the violation. Upon termination, your right to use the Service ends immediately.

10. Disclaimer of Warranties

THE SERVICE, INCLUDING ALL FEATURES PROVIDED THROUGH DRAGONCHALLENGE.APP, IS OFFERED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

Certain jurisdictions do not allow the exclusion of certain warranties; in such places, only the maximum lawful exclusions apply.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAGON CHALLENGE LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50).

In jurisdictions that do not allow limitations of liability, these limits apply only to the extent permitted by local law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Dragon Challenge LLC and its affiliates, employees, officers, and agents from claims or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms. We will notify you of any such claim and allow you to participate in the defense. No settlement admitting fault or liability may be made without your consent.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law principles. If you reside outside the United States, mandatory consumer protection laws of your country of residence also apply to the extent they cannot be legally waived.

14. Dispute Resolution

U.S. Users

Any dispute or claim arising from or relating to these Terms or your use of dragonchallenge.app shall be resolved by binding arbitration before the American Arbitration Association (AAA) in the Commonwealth of Virginia. You and Dragon Challenge LLC waive the right to a jury trial and, to the extent permitted by law, waive participation in any class or representative action.

Non-U.S. Users

If arbitration is not enforceable under your local laws, disputes shall be resolved in the state or federal courts located in the Commonwealth of Virginia, unless mandatory local law requires otherwise. Where allowed, you consent to jurisdiction in Virginia.

15. Injunctive Relief

Either party may seek injunctive or equitable relief to protect intellectual property or confidential information in any court of competent jurisdiction.

16. Force Majeure

We are not liable for delays or failures resulting from events beyond our reasonable control, including natural disasters, war, internet outages, government actions, or labor disputes.

17. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms to an affiliate, successor, or acquirer.

18. Severability

If any portion of these Terms is found unenforceable, it will be limited or modified to the extent necessary, and the remaining provisions will continue in full force.

19. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Dragon Challenge LLC regarding dragonchallenge.app. They supersede all prior understandings and agreements related to the Service.

20. Language

These Terms are provided in English. If translated, the English version controls in the event of conflict.
